Djibouti

The legal basis for trademark law in Djibouti is the “Industrial Property Act 2009”. A full trademark protection can only be obtained by registration.

Requirements:

  • Name of applicant and Physical/contact address of trademark owner.
  • Nationality of applicant,Profession or Nature of Business.
  • Type of incorporation (for corporate applicants) and Country of Incorporation (for corporate applicants).
  • Description of good / services and Desired trademark class.
  • POA, simply signed. A separate POA is required for each application.
  • All documents must be submitted at the time of filing.

Procedure:

  • Trademark application is filed before the National Trademark Office.
  • When application is received, the authority examines the submitted documents carefully to assess and verify eligibility for registration. If the application passes all examinations and meets all requirements in office actions, the trademark is approved.
  • Upon approval, the trademark is published in the Official Gazette in the country for a given period of time, usually one (1) month. This period is given to allow anyone who may not agree to registration submit his / her objection to the authority.
  • When no objection is received, the Trademark Office issues a Trademark Certificate.
  • The overall processing time approximately 6 -8 months from first filing to registration.
Duration and Renewal: A trademark protection in Djibouti is valid for 10 years from the filing date. The registration is renewable for periods of 10 years.
