Iceland

Legal basis is the Trademark Act of 1997. Iceland is a member of the Madrid Protocol. Trademark protection is obtained by use or registration. It can also be acquired by sufficient public recognition.

 Requirements:

  • Full name and address of applicant.
  • List of goods and/or classes to be covered by the application. 
  • Power of attorney (not legalized), may be filed later.
  • Certified copy of home-registration from countries which are not party to the Paris Convention.
  • Six prints of the trademark.
  • priority documents if priority is to be claimed.

Procedure:

  • The application is filed at the Icelandic Patent Office (IPO).
  • The application process includes a formal examination, an examination as to absolute grounds and an examination as to relative grounds.
  • once the trademark application is accepted, the trademark is published in the official gazette (Gazette of the Patent Office).
  • The registration of a trademark may be opposed within two months of the date of its publication by any interested party.
  • The processing time from first filing to registration or first office action is approx. 2 to 4 months if no opposition is filed.

Duration and Renewal: Protection dates back to the date of application. A trademark registration is valid for 10 years from the date of registration. The registration is renewable for periods of 10 years.

1
