Legal framework for trademark registration is based in law 20-00, Paris Convention (20 march 1883, including revision September 1979), Nice Convention, Chapter 15th of DR-CAFTA.

Trademark registration classification:



Requirements:
  • Name, address and nationality of Applicant.
  • Trademark description and international class.
  • digital sample of the design mark, if applicable
  • A power of attorney, simply signed. Original may be filed with the application or at a later stage at no additional cost.
  • A Certified copy of the priority document within three (3) months from filing date of the local application must be filed. Spanish translation of said document can be prepared locally.

Procedure:

  • A trademark application has to be filed before the "Oficina Nacional de la Propiedad Industrial (ONAPI)" by a local agent.
  • The application process includes a formal examination and an examination of distinctiveness.
  • Once your trademark has been accepted it is published in a nationwide journal. The opposition period is 45 days from publication date of the trademark.
  • If no objection by a 3rd party ONAPI approves, a certificate granting the trademark registration is issued.
  • The processing time from first filing approval for publication or first office action is approx. 1 month.

Duration and Renewal: A trademark registration in Dominican Republic is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
