Legal basis is the new Industrial Property Law, in force since May 15th, 1997. Although Brazil is part of the Paris Convention and the TRIPS agreement, it is not part of the Madrid system.

Requirements:

        • The name and address of the Applicant(s)
        • The representation of the mark as to which registration is sought
        • A list of the goods and/or services grouped on the basis of the international classification 
        • A priority document when priority is claimed. The document can be filed within 3 months after the filing date of the application.

Procedure:

  • After the application has been filed, the INPI will conduct a basic assessment of (formal) completeness.
  • Once your trademark has been accepted for registration, it will be published on the journal for 60 days.
  • After this period has lapsed, the INPI will launch a detailed exam of the application and decide whether registration will be granted or refused.
  • If no objection by a 3rd party, a registration certificate will be issued by Intellectual Property Department. 
  • It takes approximately around 30 to 36 months to get a trademark registered in Brazil.

Duration and Renewal:The trademark in Brazil is valid for ten years from the date of registration.The trademark is renewable for ten years for an unlimited number of times.
